Section 1 - Introduction
These Terms and Conditions (“Agreement”) govern the provision of catering services by Social Engine (“Caterer”) to the Client (“Client”). By booking the services of Social Engine, the Client agrees to be bound by the terms set out below.
Section 2 - Services
Social Engine offers catering services for corporate events in Melbourne, Victoria, Australia. Our services include, but are not limited to, the preparation, delivery, and setup of food and beverages.
Section 3 - Quotations and Bookings
Quotations: All quotations provided are valid for 7 days from the date of issue unless otherwise specified. Prices are based on the details provided by the client, and any changes to the event requirements may result in an adjustment of the quoted price.
Bookings: A booking is confirmed once an order confirmation is sent and full payment made.
We reserve the right to decline or cancel bookings at our discretion.
Section 4 - Payment Terms
Payment Methods: We accept payment via bank transfer, credit card, and other methods as agreed upon.
Section 5 - Cancellations and Amendments
General Cancellations: Cancellation charges apply once your catering requirements have been confirmed verbally or in writing and where costs have been incurred for food, labor, or other services.
Cancellation Deadlines:
10 to 50 people: 2 business days prior to the event.
50 or more people: 5 business days prior to the event.
Staff Cancellations: Full staff charges may apply if staff are canceled within 1 business day prior to the event.
Amendments: Any changes to the booking must be communicated in writing at least 48 hours before the event. While we will endeavour to accommodate changes, they may be subject to additional charges.
Exceptional Circumstances: We understand that cancellations may occur due to unforeseen circumstances. We will work with you to minimise the cost of cancellations.
Section 6 - Refunds
Administration Fee: In the event that a refund is issued, Social Engine reserves the right to charge a 2% administration fee to cover merchant fees and administrative time. This fee will be deducted from the total amount refunded.
Section 7 - Event Changes and Delays
Event Changes: Any changes to the event date, location, or requirements must be communicated as soon as possible. We cannot guarantee our availability for rescheduled events and may treat rescheduling as a cancellation.
Delays: If the event start time is delayed by more than 30 minutes due to the client or their guests, additional charges may apply.
Section 8 - Menu Selection and Dietary Requirements
Menu Selection: Final menu selections must be provided at least 1 week prior to the event. Failure to do so may result in limited menu options.
Dietary Requirements: We cater to various dietary needs; however, it is the client’s responsibility to provide accurate dietary information for their guests. We will not be held responsible for any adverse reactions if incorrect or incomplete information is provided.
Section 9 - Service and Equipment
Staffing: Our service includes trained staff for food and beverage service. The number of staff required will be determined based on the event size and service style.
Equipment Hire: If additional equipment (e.g., coffee and tea stations, BBQ hire) is required, it will be quoted separately. The client is responsible for any loss or damage to hired equipment.
Section 10 - Food Safety and Liability
Food Safety: We follow strict food safety guidelines. However, once food is delivered or set up, we cannot be held responsible for its handling or storage by the client or their guests.
Liability: Social Engine will not be liable for any indirect, special, or consequential losses. Our total liability under these Terms will not exceed the total amount paid for the services.
Event Insurance:
We recommend that clients obtain event insurance to cover unforeseen circumstances, including cancellations, damages, or injuries during the event.
Force Majeure:
Social Engine is not liable for any failure to perform its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, lockouts, or other events considered to be acts of God.
Section 11 - Governing Law
These Terms and Conditions are governed by the laws of Victoria, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Victoria.
Section 12 - Privacy
We respect your privacy and will only collect, store, and use your personal information in accordance with applicable privacy laws. We will not share your information with third parties without your consent, except where necessary to provide our services.
Section 13 - Amendments to Terms
Social Engine reserves the right to amend these Terms and Conditions at any time. Any changes will be communicated to clients with active bookings.
Section 14 - Acceptance of Terms
By confirming a booking with Social Engine, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
Section 15 - Delivery Times
Weekdays: Social Engine delivers between 7:00 AM and 5:30 PM on weekdays.
After-Hours Deliveries: Deliveries or pickups required outside these hours will incur additional charges.
Cold Food Orders: Cold food orders may be delivered up to 90 minutes prior to your confirmed delivery time.
Hot Food Order: Hot food orders may be delivered up to 15 minutes prior to your confirmed delivery time.
Weekend Orders Availability: Weekend orders are available upon request and are subject to a 15% surcharge and minimum spend requirements.
Section 16 - Terms of Trade
Corporate & Private Catering: Full prepayment of the entire order value is required to confirm your booking.
Section 17 - GST
Exclusive Pricing: All quoted prices exclude applicable GST charges. Any statutory changes to GST will be passed on to customers.
Section 18 - Pricing Fluctuations
Price Adjustments: All prices are correct at the time of printing and are based on current costs. Prices may vary due to seasonal or supplier changes.
Right to Alter: Social Engine reserves the right to alter or adapt menus, prices, and services as needed.
Section 19 - Accuracy of Billing and Account Information
In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made.You agree to provide current, complete and accurate purchase and account information for all purchases via Social Engine Catering. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
Section 20 - Lost or Broken Equipment
Replacement Costs: Any lost or broken equipment will be charged a replacement cost.
